Need your help. Can I ask my employer to file a new perm labor processing while I am on EAD status (pending my existing case)?
Idea is to do EB3- EB2 porting with a perm. I heard you can file Perm only if you are on H1 or other status and not on EAD (AOS Pending I485).

My wife will be applying for H4 visa (1 st time) some time in march. I am currently working on H1B in US.
while checking the website for documents required for H4, they ask for the Photocopy of the Principal Applicant�s valid visa.
Since I am a canadian citizen, I do not require a visa for US and hence I don't have a H1B visa stamped on my passport.
I would appreciate if you could reply me on this regard.

Hi,
I finished my six years of H1B in August 2008. I filed my I140 with concurrent filing in July 2007. I also received my EAD card (pending I140) but I never used it. The time has come to renew my H1B for the upcoming year. My employer filed I129, which was approved by USCIS. Now my employer is asking me to renew the EAD but I don't want to spend the money. Do I have to have the EAD with my H1B? What do you guys think?

Will there be any chance to revoke or cancel approved i140 if we file 2nd i140 with same employer . My employer is willing to give approved labor which is better (EB2 ,PD-2003) than my labor (EB3, PD-2003) . But right now i am on 6th year . I got a 3 years H1B extension recently. If my first i140 canceled (??) how about my H1B . is it still valid?

if you have EAD, alien # is same as A# on the EAD card. otherwise i think you should fill NA or none (check instructions page,for blank, what you need to fill).

Hi,
I was working for a telecom company. I passed 6 years and then was on 1 year extension. Meanwhile my I140 was approved. Lately i was given pink slip and then transfer my H1 to another company. i couldn't join the company since i was waiting for approval notice for my H1 Transfer. Today i received the denial notice for my H1 transfer and extension. I called to the lawyer and they told me to file for B2 as they haven't received the notice as of yet. So the reason of denial is still unknown. I was wondering what are my current options? Should i wait and file a motion for the H1 transfer denial or should i go ahead with B2? Please advise.

I just want to know where is my "H1B Visa Extension Application" needs to apply by my employer.
Following are the details,
1. My Employer located in Virginia.
2. My current work location is Minnesota (and applying the H1extension with this Client's letter).
3. This is my second extension; i.e First H1b is for 2 years; and second H1b(i.e extension) for 3 years . all(5years) with the same employer.

I have a question regarding my spouse who is on H4 visa.she has real experience in India for 5 years. One of the company who does some projects did H1b processing through "CONSULAR PROCESSING". Her H1B is approved now.
1) Employer is saying she has to go out of the country to get the visa in order to work.
2) Apply for change of Status while staying in USA. Employer saying that there are chances of getting an RFE during that process. Is there any Premium process in Change of Status processing.
which one is advisable?
Can any one please suggest.

My I-485 has been denied based on the fact that I entered the country illegally in 1985.
My last USA entry was in 1998. It was a legal exit and entry. I was given a permit to make a trip to South America. Can the fact that my last entry was legal be enough to reopen the petition? Can I used my last entry as basis for my I-485 adjustment?
